Pursuing Legal Matters
As MakeWay is the legal entity, Projects cannot enter into a legal dispute without consent from MakeWay. Projects are responsible for all the costs of legal consultation and litigation when they are requesting legal services.
Projects can engage MakeWay's legal counsel or their own legal counsel. Projects must review the issue and the costs with their Project Specialist before engaging any legal counsel.
Projects that would prefer to engage their own legal counsel, whether paid or pro bono, should notify their Project Specialist. Before engaging counsel, the Support Team must have a conversations with counsel to ensure they understand MakeWay structure.
Projects must have the approval of MakeWay's legal counsel and Board of Directors before engaging in private litigation or participating as plaintiffs in any legal case.
Projects that are planning activities that could result in litigation should consult with their Project Specialist before proceeding.
Project Directors must immediately notify MakeWay of any threats of litigation or claims against MakeWay as a result of Project activities. MakeWay will determine an appropriate course of action in all litigation, and retains full authority for handling legal matters.
